View Full Version : online trading: if yuo get ripped off
Hi,
I was wondering if someone could tell me about online trading law.
About 1 1/2 months ago I bought some PC parts from a guy in this RtCW clan I am a member of. I deposited the $130 in his account and he never posted it.
He didn't have a bank account so basically I did the deal with his girlfriend. The details I have are her full name and her bank account number/branch etc. She was going to post it.
I talk to him about twice a week about it and he always says he is busy etc etc.
I am really pissed off, because this stuff was originally for my girlfriends 21st (I was making her a computer - amoung other pressies of course :p). But obviously her birthday has been and gone.
I've given up on him posting it and I am continuously asking for him to refund my money. I talk to him and his girlfriend via ICQ. (his girlfriend hasn't logged into her icq account for about a month). He still logs in.
Any more info needed? What can i do?

report him to the police, oh wait, this is NZ, we don't have enough cops to deal with all the problems,
do you know where he lives?
Do you live very far away from him?

Just if it was me the fact that he didnt have a bank account would have sent enough alarm bells ringing in my head to not purchase anything off him
Basically the only thing you can do is goto the police or the small claims court
it doesnt have to be "online" law its just the law if you enter a verbal sale contract with someone and the dont supply the goods you are entitiled to a refund

I had a problem like this, and basically you're stuffed.
I have a mate who is a detective, and this is not a criminal offence so the police won't get involved. It is still against the law, but you have to take him to small claims court, or get a debt collection agency to try and get the money.
I was lucky, cause my mate went round as a favour to speak to the guy, and this gave him enough of a scare to refund my money. There was still nothing my mate could have actually done, and he shouldn't even have been carrying out non police business.
Sometimes there are other things that can be done. Do you have his or his girlfriends address? You could post it, but that may be really terrible as someone might slash his tyres, or coin his car etc.

Still havnt got it back. Im not to fussed about it now but if i do stumble accoross the guy.... and have a bat handy because i heard hes one fat mofo... you know the rest.

He is definatly "one fat mofo" I have pics of him sleeping under a table at a LAN a while back if u want them :D
Anyway, i have been luckyenough to not be ripped off by anyone over about 2 years of trading online. Mostly it was though Tard Me, but just latly it has been through OCNZ. If it were my 150odd that he had i would take it to the small claims court. I mean that is money that you would probably never see again.

Through some online detective work I have his First name, his home phone number, his cellphone number, his address, his birthday, his last vehicle he owned, his online nick names on various forums.
I also have all of the above for one of his friends that was involved in a car crash with him.
He is in auckland.
Anyone in Auckland who has been ripped off want to take it out on this guy? He's only 19 and isn't tough at all. He lives with his parents.
I talked to him today and he promised to send/deposit on Tuesday. During our conversatino he said "the deal was u paid for the parts, i send them, i never said when".
I get the feeling it's NOT GOING TO HAPPEN.

Give him every chance - it's not like thursday is any worse. Maybe you could try contacting his parents if he doesn't front up this week?

1 1/2 months isn't every chance? I suppose I could ring his parents sometime this week while he is at work. I can imagine they would be pretty pathetic parents if their son does this type of crap.

I suggest you put on a serious voice and ring up his house and ask for the mother or father of "dudes name" and explain to them that their son has been taking money for computer parts and not sending the parts... tell them if he doesn't devilver the parts within 2 weeks you will be taking him to court..
That might do the trick.. worth a shot anyway.. and if it doesn't then take him to the small claims court..
if he is scared of sending it, I can probably drop by his place if it's close by to pick up the stuff and send it off.
what are the first 3 digit's of his home number?

They are different suburbs but not all that far apart (they border each other pretty much)

Hi MoNk, did you get the guy? Hope you get satisfaction. Nobody likes being ripped off, especiall by a stuck-up little squirt in another town who lives with their parents. If you made a deal with him, there must be a paper trail? unless it was by phone? If the cheque has been cashed, that means the deal has been accepted, and must be honoured. What do the community lawyers/small claims say about this? Don't give up! it is a matter of principle! Thieving b*stards must be stopped!
